A citizen applied for a visa and substantiated complete financial capability by submitting bank statements showing liquid funds of nearly 100,000 euros. The authority issued a summary refusal, claiming the financial means were insufficient. The decision contained no financial calculations, no statutory benchmarks, and no reference to required daily subsistence rates. Multiple written requests for clarification from the applicant were met with total silence.
In the final decision, the submitted correspondence was ignored and the boilerplate phrase was repeated verbatim. The authority dismissively referred the applicant to the Federal Administrative Court, stating that if the applicant disagreed, the court would have to decide.
When the citizen turned to the supervisory ministry, three ministerial officials, a representative of the State Police Directorate, and thirteen further public authorities confirmed independently of one another that the submitted financial proof fully satisfied established administrative practice. Shortly thereafter, however, the ministry executed an abrupt reversal to shield the embassy's decision. Confronted with the seventeen concurring official statements, the ministry claimed that the other officials had misunderstood the matter and had merely provided informal joke advice.
When the case was presented to the Ombudsman Board, the oversight body sided with the ministry: It accused the citizen of setting a trap for the ministry by cross-checking official advice with other public authorities. Furthermore, the Ombudsman Board declared the refusal to provide information lawful, arguing that guidance on financial criteria could only be granted after an application had been formally submitted.
To prevent further application attempts in other jurisdictions, the ministry instructed missions abroad not to disclose daily subsistence rates or minimum financial thresholds to the applicant. The statutory duty of administrative guidance was bypassed in order to maintain a deliberate information asymmetry.
This constructs an airtight administrative catch-22: before applying, the citizen is denied the governing criteria; after applying, the application is rejected for failing to meet undisclosed standards, leaving the applicant to face years of costly litigation. Even prevailing before the administrative court often proves futile, as officials face no personal consequences for baseless decisions and can simply introduce alternative pretexts in subsequent applications.
Forensic Assessment: Because formal written filings do not vanish within established filing registries and administrative law mandates a comprehensive evaluation of the complete record, this does not represent innocent oversight. It is a structurally corrupt process in which administrative procedures, statutory reasoning requirements, and judicial remedies are weaponized to suffocate citizen rights through systematic procedural attrition.
